United’s New Refund Policy Is An “Unfair and Deceptive Practice’ Per DOT Guidance

Airlines are required to provide a refund when they cancel a flight, or make a significant change to their schedule. Federal law does not define what either of these two things mean, so airlines can create their own definition as long as it’s reasonable. United has adopted an unreasonable interpretation.

However the Department of Transportation reminds that even that new interpretation cannot be applied retroactively to tickets that were purchased before it went into effect.

You CAN Get A Refund Even If You Already Accepted A Voucher For A Cancelled Flight

Early on in the pandemic I told you to wait to cancel your travel plans. Two months ago I suggested that future plans shouldn’t cancelled right away because if the travel provider cancels on you then you’ll be entitled to a refund, while if you cancel plans when a flight is still operating all you can get is a voucher.

Many consumers were duped by airlines into taking vouchers when entitled to a refund. It’s not too late for them to get their money back.

Delta’s Lawyers Tell The Government Air Travel Is Unsafe and Should Be Limited. Say What?

Delta lawyers submitted a filing to the Department of Transportation in which they make the case that travel is unsafe and flights should be limited if at all possible.

That’s not the position Delta takes in public or emphasizes with employees. But it’s a convenient argument to make when they’re trying to reduce their service obligations under the federal airline bailout.

United Is Still Flouting DOT Refund Rules For Cancelled Flights

United is effectively saying that they will not provide refunds for cancelled flights, only for significant delays, because cancelled flights do not exist. They are treating DOT rules – which specifically provide for two separate reasons for a refund – as though they only provide for one.

If an airline used to fly 8 times a day between two cities, and now flies just 3 times a day, that airline has cancelled 5 flights even though the airline can still accommodate the customer. United disagrees, but that is absurd on its face.

US Government: Airlines Must Contact Everyone They Refused A Refund To And Offer One

DOT is telling airlines that continuing to deny refunds for cancelled flights and significant schedule changes is “a violation of the carriers’ obligation that could subject the carrier to an enforcement action.”

However the government will not act against airlines that have improperly refused refunds already provided they get their act together and fix their policy, educate staff about the change, and contact everyone that already took a voucher to let them know they are entitled to a refund.

U.S. Airlines Asking The Trump Administration To Scale Back Government’s Role in Consumer Protection

Airline lobbyists are trying to curtail the power of the Department of Transportation to engage in consumer protection. They want to be regulated just like other industries, with definitions employed by the Federal Trade Commission. But this ignores how other industries are regulated by the states and consumers through the courts, which the airlines are frequently excused from by the Airline Deregulation Act.
