Yikes: Delta Flight Attendant Pounded Cans Of Wine, Began Vaping, And Sexually Assaulted Passenger

A Delta Air Lines flight attendant pounded five cans of wine, began vaping, and sexually assaulted a passenger while traveling as a nonrev on the Atlanta-based carrier, according to a new lawsuit.

The off duty crewmember kissed the woman and touched her up against her will, as working crew continued to ply their colleague with alcohol as she became visibly more and more intoxicated.

Her defense appears to be that she drank too much! She says he has no recollection of the events in question. Eventually she wound up hospitalized, so drunk she fell down an escalator. Twice.

This all happened in November 2022, according to the suit, on board a Delta Air Lines flight from Las Vegas to Minneapolis.

The non-working flight attendant had been given two cans of wine on the flight, and then two more, eventually kissing this other passenger without her consent. The passenger complained to flight attendants, but the suit says that they gave the offender… another can of wine. She started vaping and rubbing her victim’s bum.

After Alison got off the plane, she immediately alerted Delta gate agents and requested law enforcement so she could report an alleged sexual assault. At this point, two of the working flight attendants got in contact with the suspect, with one of them telling her that she had been “pretty bombed” (very drunk) during the flight.

Trebnick-Emerson, however, appeared to have no memory of kissing the victim, reacting with surprise in text conversations with her colleagues.

The passenger reported the incident after the flight. Eventually the nonrev passenger took a plea for disorderly conduct. Now the passenger is suing Delta for negligence in overserving their clearly intoxicated employee.

  1. Another problem with our society is ambulance chasers. Anytime something happens someone has their hand out and thinks they won the lottery. This woman had a bad experience but wasn’t permanently damaged so get over it and move along instead of looking for money. So pathetic!

    I am a heterosexual male. I am making the assumption both of you are, too. But even if neither of you are, is it so difficult for you to sympathize and see the victim’s point of view? What if the victim had been your sister, your daughter, or your mother? Would you feel differently about what is being reported? Would you tell your female family member to “grow a pair” after being kissed on the mouth against her will, and then had her a** rubbed as she was de-boarding, and that she shouldn’t feel uncomfortable, and not to worry the next time she gets on a plane? What if instead it were your son who was the victim, and what if the assailant, instead of being female, had been an off-duty male airline employee? Would you feel differently then?

    What else is the victim supposed to do in this case? It’s reported she told in-flight crew, but crew did nothing in the immediate aftermath, and worse, allegedly served the female off-duty employee another can of wine. The victim then reported the incident to gate agents upon landing, but as part of the justice system, the case was plea bargained down to disorderly conduct. How is this a case of “ambulance chasing”? If the victim does not sue Delta Airlines over this incident, what is the correct course of action in your opinions?

  4. Why do people need to drink on a flight? We’ve.banned smoking, now let’s ban drinking. Apart from the bad behavior, alcohol causes dehydration and also doesn’t taste that good at that altitude.

    It’s the more litigious society and bigger amounts of money involved in litigation in the US that makes management at US workplaces less tolerant of sexual harassment than management of European workplaces — even European workplaces in countries which are often said to be far more “feminist” than the US.

    If you believe in the dignity of and respect for of all workplaces’ employees regardless of an employees’ sex/gender, religion, ethnicity, national origin and age and care about your female relatives’ being respected and treated equally with men at work and work-related events, then you should be thankful that we have the litigation we do have in the US.

    An armed society is a polite society? Not so much as a litigious society is when such society advances the cause of equal treatment under the law and stands against discrimination on the basis of sex/gender, ethnicity, religion, national origin and age.

    Be thankful for the America that works — including the trial lawyers who help assure that women are treated with respect at work and free from sexual harassment.

  6. For the sexual assault charge to stand in court, will that not require a demonstration of willful sexual intent by the defendant when the unwanted contact was made?

  7. The passenger harassed is entitled to feel their feeling (isn’t that we tell children now…your feeling are valid). What this passenger is not entitled to is some overly bloated settlement that will probably be in the millions for getting felt up by a drunken fool.

    An apology? Yes. Refunded airfare? Yes. A free flight or some miles? Sure. Millions of dollars for a kiss an a@@ grab? Absolutely not.

    There should be consequences. Hitting the lottery should not be me of them.

  8. I certainly hope the off-duty employee and the FAs that failed to take action are both grounded. Nobody should be bothered by someone else but esp. in-flight and absolutely not in any type of sexual manner.
    and, yes, overnight flights are riskier in that regard.

  9. @SOBE ER DOC I am not a lawyer, nor have I ever sued anyone / any entity, nor have I ever been sued, nor have I ever been harassed on a plane, nor have any of my family members been harassed on a plane.

    If employees of a business are told by someone that another person is touching and kissing them against their will, and these actions are taking place on company property, and those employees allegedly continue to serve alcohol to the alleged offender thereby exacerbating the situation (whether or not the alleged offender is an off-duty employee or not), why shouldn’t the company be held liable?

    Whether or not the plaintiff is awarded “millions of dollars,” or potentially significantly less (or perhaps nothing at all), is it really “hitting the lottery” if one had to endure unwanted kissing and touching in a confined space, even after one reported the incident to employees who at the very least should have cut off the alcohol supply? If that’s “winning,” it surely is a pyrrhic victory.

    Assuming you are a heterosexual male (not that that should matter), what if you were seated next to an inebriated male passenger who just so happened to be a former convict of sexually assaulting other males, and then that person touched you, and then you reported the incident to employees, but instead of helping you, they instead gave that drunk, former convict more alcohol. Would you feel differently then about any potential lawsuit monies which you may be awarded? Would you feel as if you had won the lottery then?

For those who trivialized this incident, my wish for you is that you or a member of your family experience unwanted sexual assault someday. No, I don’t really wish that on you, but if it does, come back here and post about it, so we know whether you have or have not changed your opinion on unwanted sexual assault.

  11. The other flight attendants say the suspect was “pretty bombed” and yet they had no qualms about giving her more wine? It also appears they did not stop her from vaping. I hope there are suitable punishments for them as well.

    Also, telling a sexual victim to “get over it” is disgusting.

  12. To all the idiots saying she should not win the lawsuit lottery and sue them for every cent… this is the exact scenario lawsuits are here for. A negligent business causing pain and suffering to the public. If you just give her a BS apology and a free flight she will never even use because it’s your crappy airline, what incentive is there for the company to change? Shit, it’s cheaper to hire sexual predators for minimum wage and then just give out the occasional free flight to their victims. When will people get it through their thick skulls that money is the ONLY language that corporations speak, so our only option is to use the threat of profit losses to course correct?

    Aggressive drunk people can’t always reliably identify the targets of their actions. Also, sexual assault is sometimes more a product of an unscrupulous character wanting to exert violent power over another regardless of the sexual orientation of the perpetrator. And thus there have been events where heterosexual male police officers or troops violently sodomized heterosexual males in their custody/detention.

    Also, my understanding of mile high club activities involves 2 willing participants doing much more than stealing a kiss, and usually in a lavatory. Right?
    FYI, you might have more luck on Spirit, Frontier or any ULCC for the sort of fun you’re looking for.

  17. Delta Air Lines DOES NOT need “representation” by the AFA or any other union except ALPA. A union would not solve anything in this matter. Instead, a union would allow Delta to fall into the same swirling pit of vomit that American and United have with their flight attendants.
