“Does Your Vacation Support Deportation?” Billboard Taken Down After Airline Threat—Now It’s A Federal Case

Ultra-low cost carrier Avelo Airlines has contracted to run 3 Boeing 737s from Mesa, Arizona for deportation flights.

Aviation blogger and New Hampshire state legislator Seth Miller (‘sbm12’ in frequent flyer forums) is suing in U.S. District Court in Nevada (where Avelo is based) to affirm his right to publicly criticize Avelo Airlines over this service. He raised $6,000 from 70 people to fund billboards criticizing Avelo, but the airline got them taken down.

The ads were displayed starting on Monday, May 5. Four days later, Mr. Miller said, he received the letter from the Avelo lawyer accusing him of trademark infringement and unfair competition. The airline said it had heard of “instances of actual confusion” among customers who mistakenly believed that Mr. Miller’s billboard was affiliated with the airline.

The lawyer said Avelo could recoup damages of $150,000 per infringement and asked that the billboards and an associated website be removed by 5 p.m. on Friday to “avoid any escalation of this matter.”

On the plus side, I now have a much better image of the billboard.

Of course, now they can also file a copyright claim/DMCA on this post since they took the photo.

The case is garnering national attention. There’s no plausible confusion and Avelo’s claim that consumers are, in fact, confused strains credulity. Miller’s right to criticize Avelo – and to identify them specifically when doing so – is fairly well-established. But the billboard company isn’t going to earn a profit on the sign if they have to spend money on lawyers. I don’t believe that New Hampshire has an anti-SLAPP statute. Perhaps State Representative Miller can address this deficiency.

That said, his tagline for the effort is “Does your vacation support their deportation?” But the truth is, if anything it’s the reverse.

  • Avelo is doing this precisely because they have planes they cannot profitably fill with vacationers.
  • The carrier is struggling. In fact, they will operate only one flight on Tuesdays starting June 10 (Burbank – Eugene, Oregon).
  • So these deportation flights help keep the carrier going.

I don’t see anything fundamentally wrong with taking up a government contract. I do see something very wrong about eliminating due process requirements affirmed by the courts, and taking the position that the courts have no say in such matters. Those of you who say ‘they’re illegal, they don’t have due process rights’ miss the point entirely: you don’t know whether someone is here in violation of the law or not without the ability to contest the claim. A U.S. citizen might be deported just because the government falsely or incorrectly said they were here illegally.

Miller criticizes the lack of due process, and also the conditions in which the transportation happens. How would a plane properly evacuate in an emergency with everyone shackled?

At MSP this morning: ICE drags a pile of shackles towards DHS vans as people board a GlobalX A321; fueled and loaded by Signature Aviation; departing for Omaha with the Minneapolis skyline in the background.

I counted ~30 people, all chained at their wrists, ankles, and waist, boarding today.

Does a business have an obligation to object to this? They might believe it’s fine, or may be indifferent and desperate for the business. But customers certainly have the right to consider whom to do business with, though encouraging boycotts rarely turns out to be effective (except when it does!).

  1. Avelo…of all airlines…should know the score: do the (moral) crime of participating in mass deportations and you will do the time of trying to repair your brand among half of the country. Avelo has the right to operate deportation flights and American citizens (including elected politicians acting as private citizens) have the right to draw attention to their actions.

    Here’s hoping the courts are consistent in their interpretation of the law.

    The lunatic idea that it is “immoral” to deport someone who is illegally in one’s country – is just that: lunacy. Brought to you by the radical left do-nothing, build-nothing, accomplish-nothing (except maybe mass death, economic destruction and general misery)
    So, no – no need to try to “shame” anyone. They don’t feel shame about something as obviously legal and moral as sending someone unlawfully in another country.
    **The “due process” argument is a separate one – and granted, there are valid points on each side to my mind.

  4. There was only one Avelo route of interest to me and it got scrapped before I had a chance to fly it.

    After Avelo decided to affiliate itself with DHS/ICE Barbie Noem, there was no way I would ever choose to do business with them. I refuse to do business with companies that deliberately and willfully choose to engage in human trafficking people.

    I thank Seth for standing up for the rule of law and against companies that don’t support due process for all persons in the US.

  6. A few months back I was plane spotting at SAN (San Diego) airport and saw a GlobalX plane on the tarmac. A little while later a convoy of busses arrived at the plane. I thought it was a sports charter. Turns out one by one, people in shackles were walking up the air stairs into the plane. Didn’t realize it was a deportation flight. I started tracking the flights and they fly in repeatedly into SAN (San Diego) usually to places in Texas or Louisiana . Now I know .

  8. I wonder if the billboard company had a clause in their contract allowing them to review and reject what was placed on the billboard. This would allow them to reject swearing and other rough language as well as sexually explicit billboards. Avelo may not be able to directly attack what is political speech since the courts may not be able to uphold the attack due to first amendment restrictions on laws.

  9. These billboards are dumb, but unsurprising. The tribal zeal to support illegal aliens remaining in America is certainly strange. If I were illegally living in Europe (because, say, I love the Alps) nobody would cry for me if authorities told me I had to leave. And you are 100% correct that putting up these billboards is EXTREMELY harmful to these communities: they need Avelo to stay in business or they’ll lose their low-fare, convenient airline service. It’s really harder for a liberal activist to exercise worse judgment.
    I’d also note your insistent on more “due process” for illegals is naive. There is due process, but it is way less than that which US citizens are entitled to. And it has to be. The Biden adminisration, shockingly, let in 10 million illegals, and nobody has really been given an explanation for why. You simply can’t have 10 million people COMPLETELY ignore US law coming in, and they cry “due process” when they’re being removed.     What if they get released on bail, and they kill a friend or family member? Would you continue to support their “right” to due process or their “right” to remain here?

    I am in favor of legal immigration. My parents are legal immigrants, and I am grateful to be here. They were/are productive members of society, my deceased Dad was a priest/pastor and my Mom is retired lab technician. They were given an opportunity and made good use of it.

    What have these illegals with violent records done with the “opportunity” they stole? Many have simply engaged in bad behavior again. They been given benefits that should’ve been used for USA citizens. I’m sure there are some that may have turned over a new leaf, but that’s typically the exception.

    For one, it’s not “half” of America who is “sane” and opposes these deportations. Polls show that 66% off ALL Americans support this effort, meaning at least half of Democrat Americans also support mass deportations. And 97% of all Americans support deporting illegal aliens convicted of crimes of violence.

    And since absolutely NONE of you complained about Obama deporting 2 Million illegals during his administration, it seems that your objections are more based on WHO is ordering the deportations.

    I didnt get “due process” when I (and the airline I worked for) followed all the regulations for travel during covid and was asked to leave Canada. But I knew it was a sensitive issue and flew back.

    Why its so hard for 45% of the population to grapple with the fact we had 12 million people ignore our laws and enter the US illegally *NOT thru a port of entry* blows my mind.

    If they ignore that law, what other laws are they going to ignore.

    1. 99% of immigrants come here in search of a better life for their children and grandchildren.

    2. Each generation’s “throwaway immigrants” fuel the economy that lets the privileged enjoy their lives more because they have low cost labor to do the things they’d rather not do.

    3. Without immigrants who have always been willing to do three times the work for half the price our business models begin to buckle and we are left with the choice of improving productivity, outsourcing, or closing down.

    Immigrants are capitalism’s drug and it’s got a very bad addiction.

Is anyone boycotting Marriott, Hilton, Hyatt ?Has anyone visited New York and Chicago in the past 4 years where a low budget hotel for $125 or a high-end for $800 is now $600 and $2,000? Because the sanctuary cities and the sanctuary Biden government was subsidizing these hotel rooms for illegals and giving them food vouchers making more money in a week than our own citizens.

  26. No disagreement, there are millions in the US ‘without status.’ BUT, the US has laws, passed by Congress, in some cases upheld by the US SCt, that must be obeyed. Some believe they were a mistake, they should be changed. The US is, in theory at least, ‘a nation of laws.’ “Due Process” requires a very specific series of actions be obeyed in every case. As an example, in criminal cases that have a possibility of jail/prison, if you ask for an attorney one will be appointed for you. (Immigration not usually included, that’s the process). The US Government has admitted there were mistakes made. Those must be dealt with before the person is forced to leave. Period.

  32. It is always interesting to see people quoting statistics. Per census dot gov press release number CB25-TPS.29, 174 million people were registered to vote and of those, 154 million people actually voted. Per Wikipedia the main two candidates got 77,302,580 votes and 75,017,613 votes. 77,302,580/174,000,000 = 0.4442677 or about 44.4% of the registered voters’ vote. The registered voters who did not vote for that candidate comprised about 55.6% of the total. The census numbers are rounded so the results are approximate but not that far off.

    What a lot of people don’t realize or don’t want to realize is the illegal immigrants and immigrants who have their status revoked have very little due process due them under long standing Federal immigration laws and regulations.

    The judicial branch and their lawyer cohort is infringing on the Constitutional powers of both the legislative and executive branch.

    You are whether you know it or not – insanely suggesting that the US taxpayer foot the bill – for defense, prosecution and the whole operational aspect – the courts and the housing of deportee immigrants.

I know Seth, I like Seth, but he’s now a New Hampshire state politician and if I were his constituent, I would not be terribly thrilled about his engaging in what amounts to a political stunt far outside of his district, where only he (and his profile) stands to gain. Though at first blush this probably is more akin to an economic boycott intended to bring about political reform, rather than true commercial speech. An interesting question of law and if Seth has political aspirations beyond his current status, then this certainly demonstrates his liberal bona fides and should increase his national exposure, of course critical for fundraising.

    Actually, yes I do.

    I carry a driver’s license which requires proof of citizenship or legal residence to receive in most states. I also carry a United States passport card in my wallet, which CLEARLY shows citizenship. Given that this is a travel site, and given that many of of have passports and passport cards, I’d wager that the proportion of site users who carry proof of citizenship or legal residence on them either directly or indirectly is rather large. Passport cards are easy to get and are supremely easy to carry around, being the size of a credit card.

    Now, toss in ancillary identification that MAY require proof of citizenship or legal residence to receive, like proof of car insurance, and the proportion goes up even higher.

    Gary, the old liberal trope that people can’t have ID, or can’t carry it, or whatever, is tired and obsolete. People do carry ID on them, of various forms, which may directly or indirectly show proof of citizenship. Come on, now.

  57. @Bob Moran – 19 states and the District of Columbia as well as Puerto Rico offer drivers licenses to undocumented immigrants. It’s also possible to get car insurance with such a license, and I believe that State Farm, Progressive, Allstate and others offer policies to undocumented drivers in these states.

    So, no, a drivers license and proof of insurance is not proof of citizenship.

    Finally, I mentioned passport cards, which a lot of Americans have and carry in their wallets everyday because of their small size and ease of carry. Toss in VA cards, Social Security cards, and all sorts of other secondary forms which require either citizenship, proof of residency, or similar, to receive and… Yeah, ID showing one’s legal status is very easy to carry.

    And passport cards make up about 15% of passport issuances in the United States. Fewer than half of Americans have passports. I do not get what makes you think that people generally carry these or carry social security cards (which aren’t designed for daily carry – the material won’t hold up).

  64. @Gary Green card holders are required to carry it at all times. If you barely speak English and are an adult and don’t have your green card the chances are high you are illegal or at least just visiting.

    We really need to require proof of legality Real ID, Green Card, or passport that everyone should carry, but we don’t currently. A citizenship card would be good.

    It’s crazy to give illegal aliens drivers llicense. It shows the people who run this country are nefarious and only care about foreigners who shouldn’t even be here

  65. Actually Gary, most Americans DO carry period of citizenship ….. in the form of a “Real ID” driver license. According to DHS, about 60% of Americans’ current driver licenses or personal IDs are Real ID compliant. And many, many more Americans are rushing to get them.

    Getting a Real ID requires proof of citizenship — that’s the whole point. Add to that those people who hold passports, passport cards, military IDs and a host of other types of acceptable federal or tribal IDs and who don’t feel the need to get a new DL, that’s a significant majority of Americans who can prove their citizenship at any time. And that percentage is only growing like crazy, as people realize they need this proof to get on an airplane.

    No, 60% of drivers licenses are REAL ID, but only 70% of Americans have drivers licenses [85% of the population that’s 16 and older, remember the administration wants to deport kids, too!]. It’s 42% of the population that has a REAL ID, which isn’t most.

    And btw REAL ID is not proof of citizenship, it’s also available to legal residents and to those with Deferred Action for Childhood Arrivals (DACA) or Temporary Protected Status… the Trump administration is revoking TPS from 300,000 Venezuelans who have been eligible for REAL ID (provided they’re old enough etc).

  68. Wow, these comments represent so much disinformation. Trump stated during his campaign that he would be doing 100s of thousands of deportations starting Jan 20th. So far, he has not deported even 100,000.

    1-the vast majority of immigrants, legal or otherwise commit very few crimes. They do not want to get caught and try to keep very low profiles.

    2- the vast majority of illegal immigrants over stay their visas. Doing this is not criminal but an administrative violation.

    3- immigrants who cross the border illegally and caught by border patrol are processed. The vast majority claim asylum. That is allowed by US law. These individuals are tracked. Some (not all) are given ankle bracelets. But all are entered in the immigration system to have hearings on their claims of asylum.

    4- the individuals now being deported are mostly people who ICE knew their locations. Because of that, these individuals were easily rounded up. These same individuals were promised hearings on their cases, in many instances years ago.

    5-for those that think that illegal immigration to the USA has stopped, news for you, it has not.

    Trump is presently deporting the easy to find individuals. Ones who were promised that their asylum cases would be heard. Ones that the government knew where they lived. That is the due process that experts complain that these individuals are not being given.

    Here’s the issue, the slippery slope; if we deny due process to the most vulnerable members of American society, we begin a process of making it easier for the federal government to strip due process from all of us.

  69. The sensible advice has long been not to carry around your SocSec card around any more than minimally necessary and to minimize the risk of losing it along with your photo ID.

    Telling people to carry that around is just going to cause unnecessary trouble.

    While I nearly always have a passport within 20-30 minutes of where I am, I most certainly don’t carry it or other ID with me all or even most of the time.

    I don’t need ID to get around with mass transit trains and buses or to bike, walk or run. And I would certainly prefer to be able to fly around as a passenger without carrying ID.
