JetBlue Loses: Judge Rules Spirit Merger Violates Anti-Trust

Jan 16 2024

It’ll be interesting to see how this proceeds, since JetBlue really doesn’t have another game plan. They face tremendous uncertainty, but certainly could succeed with a time-consuming appeal. Their costs grow each and every month that the merger isn’t called off, however.

Better, perhaps, would be to revisit a deal with American Airlines akin to the one American has with Alaska Airlines, involving frequent flyer program reciprocity and codeshares – something the judge in that trial expressly suggested would be legal. Spirit’s board almost has to take JetBlue’s offer now unless Frontier comes up with more cash. The federal government then has to make a choice whether to sign off on it in order to kill the JetBlue-American Airlines Northeast Alliance. If they make that offer, JetBlue almost has to take it.

Frontier winds up with divested slots and gates in the Northeast anyway. JetBlue massively overpays. American loses its New York strategy. And the big winners wind up Delta and United, who face less competition for New York (and Boston).

Spirit Airlines has probably the worst reputation of any airline in America. The problem is that reputations lag reality. First of all Via Air is far worse. And second Spirit has made tremendous strides.

It’s easy to anchor on Spirit as the airline who believed their business model required customers thinking they offer a bad product, who refused a pregnant woman water during a two hour tarmac delay and that wouldn’t refund a Vietnam veteran cancer patient’s tickets when he became too sick to fly to see his daughter in the hospital. And that’s why this spoof video of a Spirit Airlines customer service center is so funny.
